BEERINBOX.EU/.ES Marketplace is a website which provides a platform for small breweries selling their own products. All purchases on our website are made directly between the seller and the buyer. The seller is responsible for the description of the goods, the timely dispatch, packaging and the quality and quantity of the goods. Payment is released to the seller after confirmation of receipt of goods.

    1)LEGAL AGE OF BUYERS AND SELLERS

    a)By accessing this website and / registering to use the Website as a Buyer, you confirm that you are the Legal Age.

    b)Any alcohol may only be purchased by persons who are the Legal Age. Any registered User who buys a product listed on beerinbox.eu/.es agrees that any alcohol received as a Buyer will only be consumed by persons who are the Legal Age.

    c)Any alcohol may only be sold by persons who are the Legal Age.

    d)At delivery to the Buyer, any shipment containing an alcoholic beverage will require the signature of persons who are the Legal Age. Proof of age may be required by the Courier. If this is not shown, delivery may be refused by the Courier at their discretion.

    2)GENERAL TERMS

The laws of Spanish govern these terms and conditions. By accessing this website beerinbox.eu/.es, and using our services/buying our products, you consent to these terms and conditions and to the exclusive jurisdiction of the Spanish courts in all disputes arising out of such access.

    d)Beerinbox.eu/.es does not hold any credit card records for people who use this site. If you buy using a credit card, you will be taken to a secure third party site which handles all our transactions. Your credit card information is never seen by us.

    4)PAYMENT

    a)BEERINBOX.EU/.ES agrees not to allow any transaction that is illegal, or is considered by the credit card brands or acquiring bank, that may or has the potential to damage the goodwill of the same or negatively influence them. The following activities are prohibited under the programs of the card brands: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Holder of the card, or cards.

    b)All credit card payments are made on the bank's webpage and are protected by SSL code.

    5)SHIPMENT, DELIVERY AND ACCEPTANCE

    a)The Seller is responsible to deliver the goods to the place designated for shipment by Buyer in the Order. Any loss or damage, whenever occurring, which results from Seller’s improper packaging or crating are borne by Seller!

    b)All items shipped shall be properly identified with Buyer’s purchase order number and any purchase order item number or other identification number shown. Notwithstanding anything herein to the contrary, Buyer shall have a reasonable opportunity to inspect the goods after the same have been delivered to Buyer’s premises within 3 days. Buyer shall not be deemed to have accepted any such goods until the expiration of such reasonable time for inspection. The parties acknowledge and understand that Buyer may inspect any commercial lot of the goods consisting of numerous units of the same product by inspecting only a reasonable sampling of such units and that Buyer may revoke acceptance of any other units of such commercial lot which Buyer at a later time discovers to be defective. Upon rejection or revocation of acceptance of any goods, Seller promptly shall replace or correct, at Buyer’s option, any unsatisfactory units at Seller’s expense, including all shipping costs. Buyer’s failure to inspect or reject goods, or payment for goods, shall not relieve Seller of any of its obligations hereunder or constitute a waiver of any of Buyer’s rights hereunder.

    c)If you need a change made to your order you should Contact the Seller as soon as possible after placing the order to try and have them adjust or cancel it before the order has shipped. Usually there is at least a 12 hour window after the order is placed to try and adjust some items, ask to combine shipping costs from multiple orders to the same Seller or to cancel your order in its entirety. However, there is no guarantee that you will be able to reach the Seller before the order has shipped.

    6)WARRANTY PROVISIONS

    a)The seller is responsible for the quality of the goods, Place of Origin, the description of the goods and it shelf life. Complain about the quality of goods can be throughout shelf life.

    b)Seller shall give Buyer reasonable advance written notice of any production change related to the Materials, including but not limited to any change in the manufacturing process, formulation, raw materials or production location. For any change that could affect performance of the Materials, Seller shall complete any reasonable qualification processes of Buyer and address Buyer’s concerns about the change.

7)Defective Goods

If on delivery any of the Goods are defective in any material respect and either the Buyer lawfully refuses delivery of the defective Goods or they are signed for on delivery “condition and contents unknown” and the Buyer gives written notice of such defect to the Seller within three business days of such delivery, the Seller must:

    ·Replace the defective Goods within 30 days of receiving the Buyer’s notice; or

    ·Refund to the Buyer the price for the goods which are defective included shipping cost.

8)Goods Return & Refund

a)If you have not received the goods within 30 days, we guarantee you a full refund.

b)All orders are checked for accuracy before being shipped, but it is still possible for mistakes to happen. If you have accidentally received item(s) that you did not order or items you ordered are missing, simply Contact the Seller within 3 days of receipt. It is the Seller’s responsibility to supply the Buyer with a pre-paid method of return for the merchandise (which includes envelope, return address, and postage) or to reship any missing items. Once the Seller receives the returned merchandise, in the same condition it was sent, we will issue you a full refund.

c)If you would like to return any goods after receiving it, for any reason, simply Contact the Seller within 3 days of receipt. Once you are given approval for the return, return the merchandise in the same condition it was sent, and we will refund your purchase price, less the shipping charges. If the return is being made due to a mistake on the Seller’s part, the Seller is responsible for sending the Buyer a pre-paid, trackable parcel to return the merchandise. However, if an item was sent to you sealed and you opened the item, that item cannot be returned. There are no exceptions to this policy.

9)Local Customs Charges

Some International deliveries may incur local customs charges. We are not responsible for the payment of any local Customs or Duties. All invoices will be stated at their true value, no exceptions will be made. By buying alcohol on beerinbox.eu/.es you are accepting full responsibility for these charges.
